Suwon District Court recently granted a partial injunction sought by Samsung: several engineers who spent over a decade on core NAND flash design are barred from working at SK hynix until April 30, 2027 — eighteen months after departure.
The court classified NAND flash design as a national core technology and noted Samsung had placed these engineers under special management.
This means → high-end talent movement between the two giants is now judicially constrained, and the legal cost of switching employers in a design role has risen sharply — making engineers at external, smaller firms the path of least resistance for poaching.
How big is the gap, and can it be closed?
The Korea Semiconductor Industry Association projects the sector will need 304,000 workers by 2031, with a potential shortfall of up to 81,000 — of which roughly 54,000 are specialized roles including design engineers.
The main supply pipeline today — a joint Samsung–SK hynix university semiconductor program — expects to enroll only about 460 students for the 2027 academic year.
